Reduction in the value of the product
In the event of damage to the goods subject to return, the buyer is responsible for the reduction in value due to the use of the goods, if they have not used the goods in a manner that is necessary to verify their nature, properties and functioning. In order to verify the nature, characteristics and functioning of the goods, the buyer may handle and use them only as they are usually allowed to do in the store. Among other things, the value of the goods is also considered reduced if the packaging of the goods is damaged.
emiksike.ee is not responsible for product defects that arise:
- due to use not in accordance with the instructions and/or recommendations
- due to storage by the Buyer not in accordance with the instructions and/or recommendations
- due to damage caused intentionally or unintentionally by the customer
Refunds
Money for returned goods will be refunded to the Buyer immediately, but no later than 14 days after receiving the withdrawal request.
Refunds are made to the same bank account from which the purchase was paid.
If the Buyer has clearly chosen a delivery method other than the cheapest regular delivery method offered by the Online Store, the Online Store is not obliged to reimburse the consumer for a cost exceeding the cost associated with the regular delivery method.
Disputes
If the Buyer does not agree with the reduction in value specified in the offset notice, the Buyer has the right to engage an independent expert to determine the reduction in value of the goods. The costs associated with the examination are divided equally between the Buyer and eMiksike, unless the position of one of the parties is found to be unfounded. In such a case, the costs associated with the examination are borne by the party whose position was clearly unfounded.
The Customer may contact the Consumer Complaints Commission of the Consumer Protection Board, which is competent to resolve disputes arising from the contract, if the value of the disputed goods exceeds 20 euros (the complaint is considered by the commission free of charge).
