1. The terms and conditions of sale have been drawn up based on the model published on the website of the Estonian E-Commerce Association (https://e-kaubanduseliit.ee/alustavale-e-kauplejale/) and taking into account the published principles of processing personal data (for more details, see the processing of personal data).
2. The owner of the online store Ishtar trade OÜ (registrikood 17042422 e-mail info@emiksike.ee), whose online store is located at www.emiksike.ee (hereinafter emiksike.ee).
General terms
The terms and conditions of sale apply to the rights and obligations arising between the buyers of the online store emiksike.ee (hereinafter the Client) and emiksike.ee upon the purchase of goods.
The terms of this agreement and the rights and obligations arising from the legislation of the Republic of Estonia apply to all users of emiksike.ee and/or guests wishing to purchase our products.
emiksike.ee reserves the right to amend the terms of sale and change prices. All changes are displayed on the website emiksike.ee.
Entry into force of the sales agreement
emiksike.ee sells and the Client purchases the goods offered in the online store.
The agreement concluded between emiksike.ee and the Client enters into force upon payment of the specified amount by the Client to the bank account of Ishtar trade OÜ after confirmation of the order.
By placing an order in the online store emiksike.ee and making the payment, the Client confirms that he/she has read the terms of sale and agrees to them.
Prices
All prices in the online store emiksike.ee are indicated in euros and include 22% VAT.
emiksike.ee reserves the right to amend prices. If the Client has paid for their order before the seller has changed the price, the new price does not apply to this Client in this case, therefore, the Client buys the goods at the price that was indicated on the website when placing the order.
Placing an order and paying for the goods
When paying for the goods, the Client has the right to choose a suitable payment method: bank or credit cards of Swedbank, SEB Pank, LHV Pank. To confirm the order, the Client pays 100% of the cost of the goods.
The contract is considered concluded, and we begin fulfilling the order immediately after the Client has paid 100% of the cost of the goods.
Delivery of goods
emiksike.ee assembles the order and transfers it to its logistics partners after the sales contract has entered into force (after the Client has paid the invoice).
The delivery times for goods indicated on the emiksike.ee website are valid from the moment the invoice is paid.
If the Client wishes to change the agreed place or time of receipt of the goods, they must notify emiksike.ee immediately before the goods arrive at the place.
The accuracy and correctness of the data provided in the order is essential to avoid delays and misunderstandings in the delivery of the goods. emiksike.ee is not responsible for delays and misunderstandings that arise in the delivery of the goods if the delays and misunderstandings arise due to the fact that the Customer provided inaccurate data when placing the order.
Right to return goods
Based on Part 1 of Art. 56 of the Law of Obligations Act, the Customer has the right to return the goods within 14 days of receiving them.
The returned goods must be unused, undamaged and in the original packaging.
The Customer bears the costs associated with the return of the goods (up to 10€, based on Part 4 of Art. 194 of the Law of Obligations Act). An exception is the case when the reason for returning the goods is that they do not correspond to the order or are defective.
The Customer must send a notice of their wish to return the product no later than 14 days after receiving it to the e-mail address: info@emiksike.ee . The return application must include the Customer’s name, product name and reason for return.
We will pay the Customer compensation after checking the returned product no later than 14 calendar days after receiving the product.
emiksike.ee has the right to withdraw from the purchase and sale agreement concluded through the online store and not provide the service or not deliver the ordered product in the following cases:
• The product is out of stock
• The price or characteristics of the product were displayed incorrectly in the online store due to a system error in the online store.
If eMiksike is unable to fulfill the order placed in the online store, the Buyer will be notified of this within 2 working days via the contact phone number or e-mail address specified when placing the order.
Claims Procedure
Based on the Law of Obligations Act, the Client has the right to file a claim for a defective product within 2 years of receiving the product. If a defect is discovered within the first six months of the specified period, it is assumed that the product has already been sold with a defect. The nature of the defect is determined by the seller.
If a defect occurs, the Client is obliged to notify emiksike.ee by sending an e-mail to: info@emiksike.ee , and also provide the following information: name, contact information and the alleged defect. The corresponding application must be sent within 2 months after the defect was discovered.
emiksike.ee is not liable for:
• damage to the product caused by the fault or negligence of the Client
• defects caused by using the product for other than its intended purpose
• for natural physical wear and tear of the product during its normal use.
Liability and Force Majeure
emiksike.ee is liable to the Client, and the Client is liable to emiksike.ee in the event of damage caused by the other party’s violation of these terms and conditions, in accordance with the cases and extent established in the current legislation of the Republic of Estonia.
emiksike.ee is not liable to the Client for damage caused or for delay in delivery of goods if the damage or delay in delivery of goods is caused by circumstances that emiksike.ee could not influence or foresee.
Confidentiality
By using the emiksike.ee website, the Client gives their clear and informed consent to emiksike.ee to process their personal data.
emiksike.ee uses the information provided by the Client only to fulfill the Client’s purchase order and does not disclose it to third parties (except for authorized payment systems and transport service providers).
Disputes and other conditions
In the event of disagreements or disputes during the execution of these conditions, emiksike.ee and the Client shall first try to reach a common opinion through negotiations. The Client also has the right to contact the Consumer Protection Board or the Court if negotiations between emiksike.ee and the Client have not yielded any results. In turn, emiksike.ee also has the right to contact the Court to protect its rights.
